End-User License Agreement (EULA)
This End-User License Agreement ("Agreement") is between you ("you") and Arkon Technology ("Arkon", "we"). By downloading, installing, or using Ferrite — Disk Health & Diagnostics ("Software"), you agree to this Agreement. If you do not agree, do not install or use the Software.
1. License grant
Upon purchase, Arkon grants you a non-exclusive, non-transferable, perpetual license to install and use the Software for the version generation you purchased, on up to the number of devices permitted by your license key (currently 3). A license key is delivered on purchase and activated per device; you may deactivate a device to free an activation.
2. Restrictions
You may not: (a) resell, rent, sublicense, or redistribute the Software or license keys; (b) reverse-engineer, decompile, or disassemble the Software except to the extent this restriction is prohibited by applicable law; (c) remove or alter proprietary notices; or (d) share your license key to exceed the permitted activation count.
3. Ownership
The Software is licensed, not sold. Arkon retains all right, title, and interest in the Software, including all intellectual-property rights. This Agreement grants you no rights to Arkon's trademarks or branding.
4. Read-only operation
The Software is designed to read drive information and run non-destructive diagnostics; it does not, by design, write to or modify the contents of your drives. You remain responsible for maintaining your own backups.
5. Updates
Arkon may provide updates at its discretion. Updates are provided under this Agreement unless accompanied by a separate license.
6. Refunds
Purchases are processed by Polar (our merchant of record); refunds are handled per Polar's terms and our stated refund policy. A refund revokes the associated license.
7. Disclaimer of warranty
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Ferrite reports drive health and estimates but cannot guarantee it will predict or prevent any drive failure or data loss.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM THE USE OR INABILITY TO USE THE SOFTWARE. ARKON'S TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE LICENSE.
9. Termination
This Agreement terminates automatically if you breach it. On termination you must stop using and remove the Software.
10. Governing law
This Agreement is governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws rules.
